 Please read carefully before submitting your application.

Calgary Car King – CalgaryCarKing.ca

1.1. By accessing CalgaryCarKing.ca (the “Site”) or submitting an application for auto-loan financing (the “Application”), you agree to be bound by this Agreement (the “Terms”). 

If you do not agree, do not use the Site or submit an Application.
1.2. You confirm you are the age of majority in Alberta and legally capable of entering into credit-related agreements.
1.3. Calgary Car King reserves the right to modify these Terms at any time by posting an updated version on the Site. Continued use constitutes acceptance of the revised Terms.

2.1. The Site and Services are provided “as is” and may be suspended, updated, or modified at any time without notice.
2.2. Calgary Car King may, where required by law or in good-faith compliance with investigations, disclose your information to authorities.
2.3. You assume full responsibility for any reliance placed on material or tools found on the Site.

This section grants the legal authority you requested to ensure full permission to pull and submit credit information.

3.1. By submitting an Application, you expressly authorize Calgary Car King, its employees, agents, affiliates, partners, and associated dealerships (collectively, “Authorized Parties”) to:

• obtain consumer credit reports and credit information about you from one or more credit reporting agencies;
   
• verify employment, income, identity, residence, and financial information;
   
• review your credit information as often as reasonably necessary for the purpose of processing or updating your Application;
   
• submit, transmit, or disclose your Application—including all personal, financial, and credit information—to third-party lenders, financial service providers, brokers, lead providers, or motor-vehicle dealers for the purpose of securing auto-loan financing.
   

3.2. You acknowledge that lenders and financial institutions receiving your information may each:

• pull separate credit reports;
   
• make independent approval decisions;
   
• contact you directly by phone, text, email, or mail.
   

3.3. Calgary Car King does not guarantee approval, terms, or rates and is not itself a lender. All credit decisions are made exclusively by third-party financial service providers.

4.1. By providing your contact information, you consent to receiving communications from Calgary Car King through email, telephone calls, SMS/text messaging, or digital channels regarding your Application, inquiries, updates, or related services.
4.2. You may withdraw consent by contacting darian@calgarycarking.ca or 403-401-1870, or by using opt-out functions where available.

5.1. Calgary Car King may collect, store, and process personal information you voluntarily provide, including but not limited to: name, address, contact information, employment information, income, identification, banking details, and credit history.
5.2. Your information may be used to:

• process your Application;
   
• verify authenticity and prevent fraud;
   
• assess creditworthiness and match you with appropriate lenders;
   
• communicate status updates or offers;
   
• comply with legal or regulatory requirements.
   

5.3. Your information may be shared with:

• credit bureaus;
   
• lenders and finance companies;
   
• dealerships and agents including insurance partners;
   
• service providers supporting the credit-application process;
   
• legal or governmental bodies when required by law.
   

5.4. Calgary Car King retains your information only as long as necessary to fulfill these purposes or as required by law.

By submitting an Application, you represent that:
6.1. all information provided is accurate, current, and complete;
6.2. you have full legal authority to provide such information and to grant credit-pull consent;
6.3. you are not submitting falsified or misleading information.

This section is strengthened to be as comprehensive and enforceable as possible within the limits of Alberta law.

7.1. You waive, release, and discharge Calgary Car King and all Released Parties from any and all claims, losses, damages, liabilities, or expenses (including legal fees) arising from or related to:

• the pulling or review of your credit report;
   
• the sharing or transmission of your personal or financial data to lenders and affiliates;
   
• lender decisions (approval, denial, terms offered, or credit impact);
   
• delays, errors, or omissions in processing your Application;
   
• any action taken in good faith under these Terms.
   

7.2. “Released Parties” includes Calgary Car King, its owners, employees, agents, affiliates, contractors, lead providers, dealerships, partners, successors, and assigns.

7.3. You agree to defend, indemnify, and hold harmless all Released Parties against any claims, damages, liabilities, or costs (including legal fees) brought by any third party arising from your:

• breach of these Terms;
   
• misrepresentation;
   
• misuse of the Site;
   
• submission of false, incomplete, or misleading information.
   

8.1. Calgary Car King is not liable for indirect, incidental, special, exemplary, or consequential damages, including lost profits or data, arising from your use of the Site or Services.
8.2. To the fullest extent permitted by law, the maximum liability of Calgary Car King shall not exceed amounts you have paid directly to Calgary Car King (if any).

9.1. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada.
9.2. All disputes must be resolved exclusively in the courts of Alberta.

10.1. If any provision is held invalid or unenforceable, the remainder of the Terms remains in effect.
10.2. Failure to enforce a provision does not constitute a waiver of future enforcement.

11.1. Calgary Car King may terminate or restrict access to the Site or Services at its discretion, without notice.
11.2. Sections relating to credit authorization, privacy, indemnification, limitation of liability, and governing law survive termination.
